Notice Of Privacy Practices Favilous Analysis complies with the Health Insurance Portability and Accountability Act (HIPAA) and all applicable state and federal laws to protect your child’s personal and health information. All client records are kept confidential. Protected Health Information (PHI) will not be shared with third parties without written authorization from a legal guardian, except as permitted or required by law. Exceptions to Confidentiality There are specific circumstances in which Favilous Analysis is legally and ethically required to share information without written consent, including: •Emergency Situations: If disclosure is necessary to prevent serious harm or to protect the life, safety, or health of the client or others, information may be shared with emergency personnel or appropriate authorities. •Abuse, Neglect, or Domestic Violence: Favilous Analysis staff are mandated reporters. If abuse, neglect, or exploitation is observed or suspected, staff are required to report this information to appropriate public authorities. •Risk of Harm: If a client is at risk of seriously harming themselves or another person, Favilous Analysis staff may disclose information to emergency services, law enforcement, or the individual at risk to protect safety. •Communicable diseases must be reported to public health authorities as required by law. •Legal Requirements: Information may be disclosed when required by court order, subpoena, or other lawful legal processes. Use of Information for Treatment, Payment, and Operations Favilous Analysis may use or share PHI as necessary for: •Billing and payment processing •Insurance authorizations •Quality assurance and clinical oversight •Business operations and auditing •Referrals and service coordination Only the minimum necessary information is disclosed. Coordination of Care To support continuity and quality of care, Favilous Analysis staff may collaborate with other professionals involved in your child’s treatment such as physicians, therapists, or educators. Coordination may include phone calls, emails, meetings, or training sessions. Written authorization from the legal guardian is required before Favilous Analysis exchanges information with outside providers for coordination of care purposes, unless otherwise permitted by law. HIPAA Security Practices Favilous Analysis uses reasonable administrative, technical, and physical safeguards to protect personal information, including: •Secure, HIPAA-compliant electronic systems •Password protection and encryption •Restricted user access •Controlled physical and electronic record storage •Only authorized personnel may access protected health information. •Client medical records and documentation are securely stored in Favilous Analysis's HIPAA-compliant system and retained in accordance with regulatory requirements. Privacy Concerns Any suspected breach of confidentiality or privacy concern should be reported immediately. Client Rights As a client or parent/guardian, you have the following rights throughout your participation in services: Your Rights Related to Treatment •The right to receive services in a safe, respectful, and supportive environment. •The right to services delivered by qualified, trained, and supervised staff. •The right to individualized, data-driven treatment is based on ongoing assessment. •The right to be informed about the goals, methods, risks, and benefits of treatment. •The right to participate in the development, review, and revision of your child’s treatment plan. •The right to ask questions at any time about interventions, progress, or recommendations. •The right to decline or withdraw consent for treatment at any time, as permitted by your funding source. Your Rights Related to Privacy & Confidentiality •The right to confidentiality of your child’s protected health information (PHI) in accordance with HIPAA and state law. •The right to limit or revoke consent for sharing PHI with schools, physicians, or other providers. •The right to receive a copy of our Notice of Privacy Practices, which explains how PHI may be used or disclosed. Your Rights Related to Safety & Reporting •The right to a treatment environment free from harassment, discrimination, or retaliation. •The right to report concerns, complaints, or grievances about services, staff, or policies without fear of retaliation. •The right to contact supervisors, the Clinical Director, or the corporate office if concerns are not resolved. •The right to file a complaint with external organizations, including your funding source, the Texas Department of Licensing & Registration or the Behavior Analyst Certification Board (BACB). Your Rights Related to Communication •The right to clear, timely communication about scheduling, provider changes, treatment updates, and policies. •The right to request reasonable accommodations, interpreter services, or culturally responsive approaches. Your Rights as a Family •The right to have your cultural beliefs, values, language, and family structure respected in treatment. •The right to share any cultural, religious, or family preferences that you would like reflected in therapy. •The right to participate in your child’s services to the extent that is comfortable and appropriate for your family.
